All orders are binding. The buyer accepts these conditions of sale and delivery in their entirety. Our order confirmations must be checked carefully and we must be informed of any discrepancies immediately. If we no longer produce a product that has been ordered, we can offer a replacement or cancel the order.
Dimensions are listed in the following order:
width x depth x height.
We reserve the right to make changes to the construction and dimensions. We accept no liability for errors in the measurements or printing errors contained in our sales brochures. Items and sets may differ from the images shown in our sales brochures.
Items made to order
We reserve the right to apply a maximum and minimum delivery charge of up to 10% of the amount ordered for items made to order.
Tools and equipment required to execute the contract remain the exclusive property of the company even if they have been fully or partially charged to the customer.
Our deliveries shall be billed in accordance with the prices contained in our most recent price list or quote. We reserve the right to change our prices. The prices listed are net prices in Swiss francs (CHF) or, by arrangement, in euros (EUR).
We would be pleased to supply you with a written quote for larger order volumes, items made to order and items that we do not keep in stock. The prices listed in our quotes are only applicable if the indicated quantity is ordered. Price quotes are valid for 30 days.
peka sets great store by keeping its availability information up to date and ensuring that it is as accurate as possible. However, production or delivery bottlenecks may delay delivery. All information regarding delivery times is therefore purely indicative and may change, without notice, at any time.
All deliveries are made from our Mosen plant (FCA Incoterms 2020) at the expense and risk of the buyer.
We undertake to respect delivery times as far as possible. However, an unforeseen delay in delivery shall not entitle the buyer to terminate the contract.
There are additional charges for postage and packaging.
Goods are delivered subject to advance payment.
Our invoices must be settled within 30 days net of invoice date in Swiss francs (CHF) or, by arrangement, in euros (EUR).
Should a customer fail to meet payment obligations, whether in part or in full, all amounts owed by the customer to peka shall fall due immediately.
The supplied commodity remains up to the complete payment our property.
peka may charge an administrative fee from the third payment reminder onwards and reserves the right to demand an advance payment before delivering goods in future. peka reserves the right to transfer the debt to a collection agency.
We hereby expressly state that we have acquired or have applied for property rights (patents, design protection, and so forth) for the majority of our products.
All goods must be checked immediately upon receipt. All complaints must be received within eight days from receipt of the goods.
A guarantee period of two years from the delivery date applies to all products with hidden material or structural defects. The guarantee entitles the buyer to have the product repaired or replaced, depending on what is possible. However, the buyer shall not be entitled to any further compensation.
If a material or structural defect is discovered, the buyer must notify peka immediately.
The guarantee shall not apply to damage caused by normal wear and tear; incorrect use; incorrect assembly; modifications or interference; an external factor like a natural hazard, fall or blow; and so on.
Spare parts or equivalent replacements are generally available for five years.
Right to return
The buyer may return the product within 30 days of receiving it, providing that it is returned complete, undamaged and in its original packaging. The customer must bear the cost of any such return.
Any items returned after more than 30 days shall only be accepted and/or refunded by prior arrangement. Items made to order and items that we do not keep in stock cannot be returned.
We reserve the right to deduct administrative and repair costs from the customer's credit note.
We undertake not to disclose your personal data to third parties. All personal data shall be treated as confidential as a matter of course. All data necessary for conducting business with you shall be stored.
Your relationship with peka is governed by Swiss law.
